These terms and conditions govern your use of MyData's products and services. We recommend that you read the terms carefully before using the services. By entering into an agreement with MyData or using our services, you accept the applicable terms and conditions.
If you use our services on behalf of a business or organization, you confirm that you have the necessary authority to enter into the agreement on behalf of that business or organization. In such cases, the words “you”, “your” and “yours” also refer to the relevant business or organization.
MyData's services may only be used in accordance with these terms and applicable law. You must be of legal age and have the necessary legal authority to enter into an agreement with MyData.
MyData may continuously develop, improve and adapt our products and services. This may include technical changes, security updates, new features, and changes to or removal of features that are no longer supported or necessary for the service.
MyData may also update these terms from time to time. Material changes affecting the customer's agreement or use of the services will be communicated in writing within a reasonable period before the changes take effect. Price changes are made in accordance with the section “Price Changes”.
Subscriptions And Automatic Payments
When you take out a subscription with MyData and choose to pay by credit card, debit card or another payment method that supports subscription payments, you accept that MyData will automatically collect the agreed payments throughout the selected subscription period.
Payment for our services is made in advance. Payments are collected automatically in accordance with the payment and subscription period stated in your agreement. The subscription period may range from 1 month to 48 months.
Your card details are entered only once and are stored securely by our payment provider. MyData does not store your complete card details. After the first payment, future payments will automatically be collected using the registered payment method.
The subscription continues and renews automatically for the same period or a shorter period unless it is terminated in accordance with the applicable minimum commitment period and notice period.
You may terminate the subscription by sending written notice to info@my-data.dk. Notice may be submitted at any time but will only take effect once the applicable minimum commitment period and notice period have expired.
For consumer customers, the notice period is generally the remainder of the current month plus 30 days after the minimum commitment period has expired. For business customers, the notice period is generally 3 months. The exact minimum commitment period and notice period are stated in the individual agreement.
Once the termination takes effect, the subscription ends and no further automatic payments will be collected. Payments relating to the minimum commitment period or notice period will continue to be collected as agreed.
If you only wish to delete or change the registered payment card, you must contact MyData at info@my-data.dk. You must not send card details by email. When replacing a payment card, you will be given the opportunity to register the new card yourself through your customer page. Deleting a payment card does not in itself terminate the subscription and does not change the customer's payment obligations under the agreement.
Price Changes
MyData may change the prices of our products and services as a result of changes in supplier prices, operating costs, taxes, duties, legal requirements or material changes to the solution provided.
The customer will be informed in writing at least 30 days before the price change takes effect and before the next automatic payment is collected at the new price.
If a consumer customer does not wish to continue at the new price, the agreement may be terminated with effect from the date on which the price change takes effect, regardless of any remaining minimum commitment period. If the agreement is not terminated, it will continue at the notified price.
Your Files and Personal Information
When using our backup solutions, you store information, files and folders submitted by you with MyData (collectively, “Your Files”). You retain full ownership of Your Files. We do not acquire ownership of them. These terms do not grant us any rights to Your Files or intellectual property rights beyond those required to provide a functioning backup service as described below.
We may require your permission to perform tasks that you ask us to carry out in connection with the processing of Your Files, such as hosting or sharing Your Files. This includes backup features such as image thumbnails and document previews, as well as cloud-backup design choices that we make in order to administer the backup service technically for you.
You grant us the permission required to perform these tasks solely for the purpose of providing an optimal backup service. This permission also extends to trusted third-party companies with which we work to provide a functional and effective online backup experience.
You, and only you, are responsible for your conduct, the contents of Your Files and folders, and all communication with others through our cloud-backup service. It is your responsibility to ensure that you have the necessary rights and permissions to comply with these terms.
We may choose to review publicly available content to ensure that it complies with our guidelines, but you acknowledge that MyData Backup has no obligation to monitor data or files in the backup solution we provide.
We are not responsible for the accuracy, completeness, appropriateness or legality of files, user submissions or other information that you may be able to access through the backup service. We are likewise not responsible for whether your files comply with Danish law. This also applies to online communications and data traffic involving Your Files through our online backup solution.
Termination
For consumer customers, the minimum commitment period is stated in the individual agreement. The notice period is the remainder of the current month plus one additional month.
For business customers, the minimum commitment period and notice period are stated in the individual agreement. Unless otherwise agreed in writing, notice of termination must be received no later than 3 months before the end of the applicable agreement period.
If the agreement is not terminated within the applicable notice period, it will automatically renew for the same period or a shorter period.
Written notice of termination may be sent to info@my-data.dk. The customer will receive written confirmation stating the termination date of the agreement.
Until the agreement ends, the agreement and the customer's payment obligations continue as before. The customer can find information about the agreement and invoices on the customer page or by contacting MyData.
MyData may temporarily suspend the customer's access to a service if the customer materially breaches the agreement, fails to pay an amount when due, or uses the service in a manner that may harm MyData, other customers or third parties. As a general rule, the customer will receive written notice and a reasonable period in which to remedy the matter.
In the event of a serious breach, unlawful use or a material security risk, MyData may suspend or terminate the agreement without prior notice. Where technically and securely possible, MyData will give the customer a reasonable opportunity to retrieve their files or data.
Payments
Price changes are made in accordance with the section “Price Changes”.
If a payment is not received, MyData may, after written notice and the expiry of a reasonable payment deadline, temporarily suspend the customer's access to the solution until the outstanding amount has been paid.
In the event of material or repeated payment default, MyData may terminate the agreement and claim overdue amounts together with any other amounts that the customer is required to pay under the agreement and applicable law.
Payment by Mobilepay
When paying by MobilePay, MobilePay's terms and conditions in force from time to time apply.

Business Purchases
All payments for our services must be made in advance, and payment will automatically be collected according to the selected subscription period of between 1 month and 48 months. If you choose to pay by credit card, debit card or another payment method that supports subscription payments, you accept that we will automatically debit the agreed amount from your account.
If you wish to terminate your agreement with MyData, you must notify us in writing at info@my-data.dk in accordance with the applicable termination terms. Payments made to MyData are non-refundable unless a refund is provided for under these terms.
Please note that all prices shown on the business website exclude VAT. We do not charge card fees. An agreement for the supply of security services to a business is automatically renewed for the same period unless it is terminated with at least 3 months' notice before the end of the initial term. During each renewal period, the agreement or lease agreement must likewise be terminated with at least 3 months' notice before the end of that renewal period.
When you make a purchase through our partner Grenkeleasing ApS, Grenkeleasing ApS's agreement terms and conditions will apply during the agreement period. They will be presented and provided to you before you complete the purchase.
Consumer Purchases
You may pay by Visa, MasterCard, Dankort and ViaBill. We do not charge card fees. When purchasing through ViaBill, you will only receive the goods after payment. Further information about ViaBill's terms and conditions is available at: https://viabill.com/dk/legal/viabill/
Acceptable Use
You agree not to misuse the software products. For example, you must not, and must not attempt to, use our services to:
1. Probe, scan or test the vulnerability of systems or networks.
2. Breach or otherwise circumvent security or authentication measures.
3. Transmit viruses or engage in overloading, flooding or spamming.
4. Introduce malware or otherwise transmit malware through our services.
5. Send advertising, spam or other false information, including spoofing or phishing.
6. Violate Danish law in any way through your use of our backup software, products or services.
Receipt For Card Purchases
All MyData customers who purchase by credit card will be provided with a receipt. Customers will automatically be able to access a receipt for the transaction on their customer page.
Right of Withdrawal for Subscriptions (Consumer Purchases Only)
Subscriptions
As a consumer, you have a 14-day right of withdrawal when entering into an agreement with us.
The withdrawal period expires 14 days after the date on which the agreement was entered into.
This means that you have 14 days from the date of the agreement to notify us that you wish to withdraw. You may send an email to info@my-data.dk or use the standard withdrawal form at the end of these terms.
Refunds
If you exercise your right of withdrawal, the amount will be refunded in accordance with the law in force from time to time. We will make the refund without undue delay and no later than 14 days from the date on which we receive notice that you wish to withdraw from the agreement. The refund will be made using the same payment method that you used for the purchase unless otherwise agreed.
Commencement before the end of the withdrawal period
If the customer expressly requests that the provision of a service commences before the end of the withdrawal period and the customer subsequently exercises his right of withdrawal, MyData may demand payment for the part of the service that has already been provided, in accordance with applicable law.
Return Of Physical Goods
Computers and other hardware sold as part of a service, upgrade or repair are not accepted for return unless otherwise agreed or the customer has a right of withdrawal under applicable law. This does not limit the customer's rights in the event of faults or defects.

If goods are returned and have lost value as a result of use or handling beyond what was necessary to establish their nature, characteristics and function, MyData may deduct the reduction in value from the refund.
We recommend that goods are returned in their original packaging with all included accessories. Missing or damaged packaging may result in a reduction in value if it affects the resale value of the goods.
Refund of the Purchase Price
If the customer has the right to withdraw from the purchase, MyData will refund the payments received no later than 14 days after receiving notice of the withdrawal.
Any additional delivery costs resulting from the customer choosing a more expensive delivery method than our least expensive standard delivery option will not be refunded.
As a general rule, the refund will be made using the same payment method used for the purchase. MyData may withhold the refund until the goods have been received or the customer has provided documentation showing that the goods have been returned.
Right of Withdrawal for Business Purchases
Business customers do not have a right of withdrawal unless otherwise agreed in writing.
Newsletters and Contact by Email
When ordering a MyData software product, you may also consent to MyData contacting you by email. Emails may contain information about new software products, tips for improving the security of your IT equipment, or relevant news.
You may unsubscribe from these emails at any time by writing to us at info@my-data.dk or by using the unsubscribe function in the newsletter. Please note that even if you opt out of marketing emails, we may still need to send you information about your product so that you can obtain the full benefit of it.
MyData ApS does not sell your contact details to third parties.
Setup Fee
If a setup fee applies to your MyData software product, it will always be clearly stated as part of the product price. MyData will never charge a setup fee that has not been clearly disclosed.
License Limitations
At MyData, it is not necessary to purchase separate security software for every individual device. Your software agreement will state exactly how many devices are licensed under your solution.
Software and Updates
Some of our software products require you to download software from our website. MyData grants you a limited, non-exclusive, personal and revocable license to use the software products solely for the purpose of accessing the services.
Your license to use the software products will automatically end if you breach these terms in a manner that affects our intellectual property rights. We reserve all rights not expressly granted under these terms.
You must not reverse-engineer or decompile the software products, attempt to do so, or assist others in doing so. Our software products may be updated automatically on your device when a new version becomes available. Your acceptance of these updates is required under these terms.
Account Security
You are responsible for protecting the password or access code that you use to access our software products, and you agree not to disclose it to third parties. You are responsible for all activity on your account, whether or not you authorized it.
You must notify MyData immediately if you become aware of any unlawful access to or activity on your account. Following the customer's initial payment, the customer will receive an email containing login details. It is the customer's responsibility to change these login details to personal and secure credentials.
Your General Responsibilities
You must not share, copy, download or upload files unless you have the rights to do so. You, and not MyData, are fully responsible and liable for what you copy, share, upload and download, and for any other use made while using our backup software and servers.
You must not upload spyware or any other form of harmful software to the cloud-storage backup service. You, and not MyData, are responsible for maintaining and protecting all of Your Files.
MyData will not be liable for any loss, corruption or costs connected with your use or misuse of our backup service, including the restoration of such files. If your contact details or other account information change, you must notify us as soon as possible so that we can update your information.
Limitation of Liability
The software products are supplied “as is” and at your own risk, without express or implied warranties or conditions of any kind. We also disclaim any warranties of merchantability or fitness for a particular purpose.
MyData is not liable for damage to your computer system, loss, corruption or other damage to data resulting from the use of our software products and backup services.
To the fullest extent permitted by law, under no circumstances will MyData, its affiliated companies, officers, employees, agents, suppliers or licensors be liable for any indirect, special, incidental, punitive, exemplary or consequential loss or damage, including loss of use, data, business or profits, regardless of the legal basis of the claim, whether or not MyData has been advised of the possibility of such damage and even if a remedy fails to fulfil its essential purpose.
Use and Limitations of Demonstration Software
By using demonstration software, including Safe ID and MyPass demo versions supplied by My Data ApS or its partners, you accept these terms and conditions.
You are granted a non-exclusive, non-transferable license to use the software for demonstration, testing or evaluation. You may not modify, adapt, reverse-engineer, resell, rent out or distribute the software, or use it for commercial purposes without an additional license.
All content in the software is protected by intellectual property rights and remains the property of the provider. The software is provided without warranties, and the provider disclaims all liability for damage or loss arising from its use. Liability is limited to the amount paid for the software, if any.
Information received through use of the software must be treated as confidential. The license terminates automatically if these terms are breached, and you must then stop using the software and delete all copies.
The provider, My Data ApS, determines the expiry date of the license, which will typically be 3 months from the date of issue.
Promotional Offers and Free Periods
Free months are provided as an overall discount on the condition that the entire agreed period is completed without early termination. If the agreement is terminated early, payment will be recalculated using the standard monthly price for the period used, and the remaining free period will lapse without refund.
When MyData sells consumer solutions, the consultant may offer 1-2 free years for the price of 1 year. In such cases, if the customer terminates after 12 months, the customer is not entitled to a refund, regardless of whether the total agreement period is up to 36 months. If the customer terminates before 12 months, any refund will be calculated on the basis of the standard price and a 12-month period, not the full 36 months.
Upgrades And Downgrades
You may upgrade or downgrade your MyData backup solution at any time. Your online-backup solution will then automatically be adjusted accordingly.
For upgrades, you will receive a new invoice for payment, after which your agreement will automatically be upgraded. You may also downgrade your agreement, with the change taking effect automatically at the next renewal.
To make an adjustment, contact our customer service team, who will be happy to assist.
Because security is MyData Backup's highest priority, we use different data centers for our customers' data. We use both European and US datacenters in order to meet our customers' preferences. Our professional servers have an uptime of 99.99%, allowing only for brief system updates during selected night-time periods.
Logins, Users and Allocation
MyData allows separate logins to be created for your software products. For example, you may create a separate user for your accounts department or separate family logins.
For each user, you allocate the amount of data that the user is to receive from the remaining capacity under the agreement. You may adjust the amount allocated to a user at any time in order to release capacity for other users. You may also upgrade and purchase additional capacity.
Changes to data allocations are made through the MyData Dashboard. Here you can add or remove storage capacity for the users you have created for the backup solution.
Additional Terms for the use of Mydata Backup
MyData Backup offers several online-backup security levels, including UltraSafe and UltraSafe Max. At our highest security levels, we are unable to assist customers because the security is so strong that neither MyData nor our storage provider has access to the encryption keys for the customer's files.
Whenever the security level of your agreement is changed, the related customer responsibilities will be stated. A customer may choose for MyData not to have access to the encryption key and may even choose a master password for the backup storage. This provides a fully private account that only the customer can access.
This also removes MyData's ability to provide support, so we recommend that the customer considers this carefully. Our support team is available to assist with any questions.
MyData Backup includes tools that can be configured to delete files from cloud storage and from the computer after a selected period. It is the customer's responsibility to select the preferred setting.
If the customer does not change the settings or installation, the “Forever Safe” level will apply. Under Forever Safe, files are never deleted from cloud storage even if they are deleted locally from the computer. If the customer changes the level, the rules applicable to the selected online-backup solution will apply. Contact our support team if you are in any doubt.
Ultrasafe Backup
Security is central to MyData. We therefore provide several encryption layers so that customers can tailor the security level of their backup as required.
With UltraSafe and UltraSafe Max, the encryption keys are assigned to the customer. By using the UltraSafe or UltraSafe Max features, the customer gives up the associated support options because only the customer holds the key to the files and their encryption.
UltraSafe Max also includes an additional passphrase. If this passphrase is lost, the files cannot be accessed or restored.
The selection of UltraSafe or UltraSafe Max is the customer's own responsibility because our ability to support the solution is removed when we do not have access. The online backup service will display a warning before the customer selects this option so that the customer can make an informed choice.
Selecting Files for Backup
The customer is always responsible for selecting the data to be included in the backup and for monitoring that selection.
During installation, several online-backup tools may be made available, including our Smart Scanner. The Smart Scanner only searches for the displayed file types and locations specified in the solution.
If Easy Setup is selected during installation on Windows, an automatic backup solution will be applied to the standard folder locations: Desktop, Documents, Pictures, Music and Videos.
If Advanced Setup is selected during installation, the customer must choose the encryption level, folders to be backed up and backup schedules. In both cases, the customer is responsible for ensuring that the selection covers the data that the customer wishes to protect.
File Versions in your Backup
MyData provides file versioning in the backup solution. Uploaded versions are stored on our servers so that the customer can return to an earlier version if something has been saved incorrectly.
The customer may adjust the rules for file versions. The most recent version will always be the version shown automatically in the Dashboard.
Backup of File Types
MyData may change the limitations applying to the file types accepted for online backup storage in order to provide customers with the most stable backup product possible.
MyData will always state the current applicable conditions in its materials. It is the customer's responsibility to remain up to date through the customer database and the terms and conditions made available to the customer.
Forever Safe and Storage
MyData offers several options for storing files directly in the cloud, including Forever Safe.
When files stored only in cloud storage are manually deleted from the cloud, the deletion is permanent. The action cannot be undone, and the customer will therefore receive a warning before confirming it.
The customer is responsible for understanding the functions of the different backup solutions selected and agreed to.
The “WIPE” Function
MyData Backup includes a tool called WIPE. This feature enables the customer, through the Dashboard, to delete all online-backup data from a device or to delete all files on the device.
The WIPE feature must be used with great care, as it may leave the device unusable and may even remove the operating system. It may, for example, be used following the theft of equipment to help ensure that files do not fall into the wrong hands.
Warnings will be shown in the Dashboard when the feature is used. If you are uncertain about the function, we recommend speaking to one of our experts before using it. The customer is responsible for understanding the consequences of using the feature.
Backup Maintenance
We continuously seek to protect our customers' backups as effectively as possible. One measure is to identify online computers that do not have an active backup setup.
If, for example, a computer is online without an active backup schedule, we may, where technically possible, create a backup from the cloud directly to the local equipment. Our aim is to protect the areas accessible from the cloud that we identify as important on online equipment without an active backup schedule. The process is fully encrypted.

Backup of Mobile Devices
MyData offers backup products that allow cloud-backup storage for mobile devices using iOS and Android. If you are uncertain whether your agreement includes this, you may contact our support team at any time.
The backup software will indicate which files your mobile device allows to be backed up. Online backup of mobile devices uses Forever Safe as the cloud-storage setting. The files backed up will therefore remain stored in the cloud until the customer deletes unwanted files through the Dashboard.
Upgrade Due to Excess Usage
Customers can clearly monitor their data usage at any time through both the software and the Dashboard. We can also be contacted in the event of any uncertainty.
Customers may adjust the data protected online through the Dashboard and remove unnecessary or unwanted data.
If an account has exceeded its data quota for 14 days, the account will automatically be upgraded and invoiced in accordance with the billing terms applicable to the agreement. An upgrade will always consist of 20% of the previously purchased data quota and will be invoiced at the corresponding price.
The customer will be informed in writing before the automatic upgrade and charge, and we will always attempt to contact the customer before an upgrade takes place. The customer may downgrade the account and quota at any time.
Service Terms for Mypass Software
General
These terms apply between the individual user of the service at mypass.mydata.dk and MyData. These terms constitute the agreement between the user, the service and MyData.
1. Registration And User Access
The user is responsible for ensuring that the information provided is correct at the time the agreement is purchased. When making payment, the user may only provide information relating to the user's own payment and credit card.
When registering for access to the service for the first time, the user must enter a username and password, referred to below as the “login details”. The user's login details are personal and may not be used by others.
The user must keep the login details in a secure place so that others cannot gain access to them. The user is responsible for all use of the user account. If the user suspects unauthorized use of the login details, the user must immediately notify MyData and change the password.
2. Fees And Payment
Payment for the subscription is made according to the periods selected for the subscription. The subscription will automatically renew for the same period unless the service has been terminated beforehand.
3. Adjustments And Changes
MyData reserves the right to change fees and other terms for the service. Changes must be notified to the user no later than thirty (30) days before they take effect.
In the event of such changes, the user has the right to terminate the account with effect from the date on which the change takes effect. If the user does not terminate the account before the change takes effect, this will be regarded as acceptance of the change.
Changes that are clearly beneficial to the user will take effect immediately without prior notice.
4. Liability
MyData will under no circumstances be liable for direct, indirect, incidental or special loss, damage or consequential loss. Under no circumstances will MyData be liable for loss of profits, earnings, income, data or use, whether arising from an act by you or a third party, under contract, or from your access to or use of the website.
Special Service Terms for Mydata Remote Assistant
1. Use Of Website Information
You may download, view, copy and print documents and graphics incorporated into those documents (the “Documents”) from the website, subject to the following conditions: (a) the Documents may be used solely for personal, informational and non-commercial purposes; and (b) the Documents may not be modified or altered in any way.
Unless your use constitutes fair use under copyright law, you may not otherwise use, download, upload, copy, print, display, perform, reproduce, publish, license, post, transmit or distribute any information from this website, in whole or in part, without MyData's express permission.
2. Disclaimer
MyData will under no circumstances be liable for direct, indirect, incidental or special loss, damage or consequential loss. Under no circumstances will MyData be liable for loss of profits, earnings, income, data or use, whether arising from an act by you or a third party, under contract, or from your access to or use of the website.
Unless expressly stated otherwise, the website and all content, materials, information, software, products and services provided through the website are supplied “as is” and “as available”. MyData expressly disclaims all warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose and non-infringement.
MyData does not warrant that: (1) the website will meet your requirements; (2) the website will be available without interruption, on time, securely or free from errors; (3) results obtained through use of the website or services offered through the website will be accurate or reliable; or (4) the quality of any product, service, information or other material purchased or obtained through the website will meet your expectations.
Any content, material, information or software downloaded or otherwise obtained through use of the website is obtained at your own discretion and risk. MyData accepts no responsibility for damage to your computer system or loss of data resulting from the download of content, materials, information or software.
MyData reserves the right to make changes or updates to the website at any time without notice.
3. Indemnity
You agree to defend, indemnify and hold harmless MyData, its directors, employees and agents against all claims, liabilities, damages, losses or expenses, including reasonable legal fees and costs, arising from or in any way connected with your access to or use of the website.
4. Use Of Software
Any use of software and accompanying documentation downloaded from the website is subject to the terms of a software license agreement between you and MyData. You must read the license agreement and indicate your acceptance of its terms before installing or using the software. All rights, titles and interests not expressly granted are reserved.
5. Third-Party Websites, Content, Products and Services
The website provides links to websites and access to content, products and services from third parties, including users, advertisers, affiliates and sponsors of the website.
You agree that MyData is not responsible for the availability or content of third-party websites. You should review the privacy and other policies published by other websites before using them.
You agree that MyData is not responsible for third-party content available through the website, including opinions, advice, statements and advertisements, and you understand that you bear all risks associated with using such content.
If you choose to purchase products or services from a third party, your relationship is directly with that third party. You agree that MyData is not responsible for: (1) the quality of third-party products or services; or (2) fulfilment of any terms of your agreement with the seller, including delivery of products or services and warranty obligations relating to purchased products or services.
You agree that MyData is not responsible for any loss or damage that you may incur through dealings with a third party.
Special Service Terms for Complete Computer Service
Complete Computer Service is a subscription-based service under which MyData provides ongoing maintenance, support and computer setup.
Any computer supplied as part of the agreement becomes the property of the customer.
Maintenance includes ongoing optimization, updates, troubleshooting and system clean-up for the purpose of ensuring stable operation and good performance. The agreement does not cover physical damage, misuse or third-party software outside the standard setup.
Setup includes standard installation of the operating system, security software, basic configuration and transfer of existing data to the extent possible.
After 36 months of active subscription, MyData offers replacement with a new computer with a value of up to DKK 5,000, based on a specific assessment of the customer's needs and the models available.
The right to a new computer requires the subscription to have remained active and paid for at least 36 months. If the agreement ends before that time, the right to replacement lapses.
The customer may, however, choose at any time to pay the remaining subscription period in full, in which case the right to replacement is maintained.
If the customer wishes to receive a computer above this value, this may be arranged upon payment of the price difference. All equipment included in the agreement is supplied and handled through MyData.
Special Service Terms for Safe Id
The provider makes the service available to you on the condition that you comply with the agreement. The service is supplied “as is” and “as available” for your personal and non-commercial use.
The provider accepts no liability, regardless of the cause, for any unavailability of the service or lack of functionality resulting from difficulties in accessing content, lack of access to content or other communication-system failures.
You may use the service to search for unwanted or unauthorized activity involving your personal data, computer, bank account or similar. It is important to note that the provider is not responsible for damage or consequences resulting from such activity, even if the service has been defective or unavailable.
The provider likewise accepts no responsibility for detecting unwanted or unauthorized activity. The provider may suspend your access to the service at any time.
1. Restrictions
To use the service, you must be legally entitled to enter into agreements under Danish law and must be over 18 years of age.
The service is intended for personal use, and you may not use it to search for email addresses belonging to other individuals or third parties.
You are responsible for ensuring that the information you share with the provider does not infringe the rights of others or violate the law.
You are not permitted to: (i) transfer your right to use the service to third parties; (ii) attempt to derive the source code of the service; or (iii) remove notices concerning ownership, copyright or other rights included in the service.
The provider may suspend your access to the service if it has reasonable grounds to believe that you are using it in a manner contrary to the agreement.
2. Disclaimer
The service is provided “as is” and “as available”, and the provider disclaims all warranties and representations, whether express or implied.
The provider specifically disclaims all implied warranties, including merchantability, fitness for a particular purpose and non-infringement, to the extent permitted by law.
3. LIABILITY
You are not entitled to compensation for direct or indirect damage. The provider is not liable for indirect damage or loss, including but not limited to loss of profits, business opportunities, use, goodwill, data or other indirect, punitive, special or consequential loss, regardless of the cause.
4. Force Majeure
The provider accepts no liability for failure or delay in performing the agreement due to events beyond its control, including labor disputes, war, embargoes, government intervention, pandemics, natural disasters or delayed subcontractor services resulting from those circumstances.
5. Intellectual Property Rights
The service and its components remain the property of the provider and/or its licensors, including all intellectual property rights.
You are granted a limited, revocable license to use the service for personal purposes in accordance with the agreement. You must indemnify the provider against any claims connected with use of the service.
6. Third-Party Services
Certain parts of the service may include third-party services that are subject to third-party terms and copyrights. Your use of the service constitutes acceptance of those third-party terms, and you are responsible for any claims connected with them.
7. Confidentiality
Confidential information, in whatever form, must be kept confidential and may not be disclosed to third parties without the provider's written approval.
Your use of confidential information must comply with the agreement and these terms for a period of three years.
8. Assignment
The provider may assign its rights and obligations under the agreement to a third party that is expected to fulfil the conditions to your satisfaction.
Delivery
Hardware is delivered by parcel post through our various associated partners. Delivery within Denmark is always free of charge. Expected delivery time is approximately 1 week. All software is delivered by email or through personal assistance and installation.
Faults And Defects
In the event of faults or defects in our products and services, the customer's rights are governed by Danish law in force from time to time.
For consumer customers, these terms and conditions do not limit any mandatory rights, including rights under the Danish Sale of Goods Act relating to goods, digital content and digital services.
Complaints may be sent to support@mydata.dk. Please describe the issue and provide the relevant customer or agreement details so that we can process the matter.
Payment Cards And Payment Method
The customer chooses the payment card used for the subscription. If the customer wishes to change or replace the registered payment card, this may be done by contacting MyData at info@my-data.dk.
Card details must not be sent by email. The customer will instead be given the opportunity to register the new payment card securely through the customer page or through a payment link provided by MyData.
Changing or deleting a payment card does not in itself terminate the subscription and does not change the customer's payment obligations under the agreement.
Personal Data
When you purchase from us, we require the following information: name, address, telephone number and email address.
We register and disclose the personal data necessary to deliver the goods to you. Personal data is registered with My Data ApS and retained for five years, after which it is deleted.
We also work with a number of other companies that store and process data. These companies process information solely on our behalf and may not use it for their own purposes.
We only work with data processors in the EU or in countries that provide an adequate level of protection for your information. The data controller for mydata.dk is My Data ApS.
You have the right to be informed about the personal data that we process about you.
If you believe that the information is inaccurate, you have the right to have it corrected. In some cases, we are required to delete your personal data if you ask us to do so, for example where the data is no longer necessary for the purpose for which it was collected.
You may also contact us if you believe that your personal data is being processed in breach of the law. You can write to us at info@my-data.dk.
