These terms and conditions govern your use of the services provided by MyData. It is important that you read and understand the following terms and conditions before using MyData products and services. By using services from MyData, you agree to be bound by these terms in their entirety. My Data reserves the right to change these terms at any time. If you use our services on behalf of a company or an organisation, you accept these terms on behalf of yourself/the company/the organisation and you confirm that you are authorised to bind yourself/the company/the organisation to our terms. If this is the case, “you/your” and “you (plural)” will refer to the company/organisation. You may only use our online backup in accordance with these terms. You may only use our services if you are authorised to enter into an agreement with MyData and are not prevented from doing so by any applicable law. Our services may be further developed and changed over time without your permission and without notifying you, although we will always strive to inform all customers in good time. We may also remove content from our service at our own discretion.

 

Your files and personal information
When using our backup solutions, you store information, files and folders that you submit with MyData (collectively, “Your Files”). You retain full ownership of your files. We do not obtain any ownership of them. These terms do not grant us any rights to your files or intellectual property other than the rights that are necessary in order to provide a functional backup service as described below. We may need your permission to carry out tasks you ask us to perform in relation to your files, such as “hosting” your files or “sharing” your files. This includes all our backup features, for example image thumbnails or document previews. It also includes all cloud backup design choices we make in order to technically administer our backup service for you. You grant us the permission we need to perform these actions solely in order for us to provide an optimal service in connection with our backup services. This permission also extends to trusted third-party companies we work with in order to provide a functional and optimal online backup experience. You, and only you, are responsible for your behaviour, all content in your files and folders, and all communication with others through our cloud backup service. It is your responsibility to ensure that you have the necessary rights and permissions to comply with these terms. We may choose to review publicly available content to ensure that it complies with our guidelines, but you acknowledge that MyData Backup has no obligation to monitor the data/files in the backup solution we provide. We are not responsible for the accuracy, completeness, suitability or legality of files, user posts or other information that you may be able to access using the backup service. Nor are we responsible for the rights to your files under Danish law. This also applies to online communication and data traffic involving your files via our online backup solution.

 

Software and updates
Some of our software products require you to download our software from our website. MyData grants you a limited, non-exclusive, personal and revocable licence to use the software products solely to access the services. Your licence to use the software products will automatically be terminated if you breach these terms in a way that affects our intellectual property rights. We reserve all rights that are not expressly granted in these terms. You may not reverse engineer or decompile the software products or attempt to do so, nor may you assist others in doing so. Our software products may be updated automatically on your device when a new version is available. Your acceptance of these updates is required in accordance with these terms.

 

Account security
You are responsible for protecting the password or access code that you use to access our software products and you agree not to disclose it to any third party. You are responsible for all activity on your account, regardless of whether you have given permission or not. You must immediately notify MyData if you detect any unauthorised access or activity on your account. After the customer’s payment at startup, the customer will receive an email with login details. It is the customer’s responsibility to change these logins to something personal and to keep them secure.

 

Your general responsibilities
You may not share, copy, download or upload files that you do not have rights to. You (and not MyData) will be fully responsible and liable for what you copy, share, upload and download or otherwise use while using our backup software and servers. You may not upload spyware or any other malicious software to the cloud storage backup. You (and not MyData) are responsible for maintaining and protecting all your files. MyData will not be liable for any loss, corruption or costs connected with your use or misuse of our backup service, including the restoration of such files. If your contact information or other information connected to your account changes, you must notify us as soon as possible so that we can update your information.

 

Limitation of liability
The software products are provided “as is” and at your own risk, without any express or implied warranties or conditions of any kind. We also disclaim any warranties of merchantability or fitness for a particular purpose. My Data is not liable for any damage to your computer system, loss, corruption or other damage to data arising from the use of our software products and backup services. To the fullest extent permitted by law, under no circumstances will MyData or its affiliated companies, officers, employees, agents, suppliers or licensors be liable for (A) any indirect, special, incidental, punitive, exemplary or consequential damages (including loss of users, data, business or profits), regardless of the legal theory and whether or not MyData has been advised of the possibility of such damages, even if a remedy fails of its essential purpose.

 

Termination
You should be aware that we never automatically shut down your solution and that your agreement will always be automatically renewed for the same period or a shorter period when it expires. For example, if you have entered into a contract for a 1-year security solution for your company with MyData, you can expect your agreement to be renewed for 1 year if My Data still offers the same solution at the time of renewal. You can stop using our online services at any time. Please note that the notice period after the end of the binding period is always at least the current month plus 30 days for private agreements. For business agreements, the notice period is 3 months. If you are in doubt, please contact our support or your contact person for clarification of your specific agreement. You terminate your agreement by sending us an email about this at info@my-data.dk. On your personal customer page you will find information about your agreement as well as invoices. We may suspend or terminate your use of our software products if you do not comply with these terms or use the service in a way that may harm MyData. If we suspend or terminate your use, we will try to give you prior notice and help you retrieve your files. In certain special cases, we may terminate your use of our cloud storage service without notice, for example in the event of a serious breach of these terms. If we terminate your use of our cloud storage service due to a breach of our terms or applicable law, no form of refund will be provided.

We would like to make it clear to our customers that it is possible to terminate their agreement with us at any time.

However, it is important to note that even though termination can be submitted at any time, there is a binding period attached to your agreement. In addition, business customers must submit their termination no later than 3 months before the end of the binding period, while private customers must terminate at least 1 month in advance. This means that if you choose to terminate your agreement before this period has expired, the termination will only take effect upon expiry of the period. In other words, although you can submit your termination at any time, you are still obliged to fulfil the period to which your agreement is bound and to comply with the notice period applicable to your customer type.

The length of the binding period and the notice period vary depending on the specific agreement you have entered into with us, and we encourage you to review your agreement or contact our customer service to obtain precise information about your binding period and the specific notice periods applicable to you. Payments
We reserve the right to change prices and to stop offering specific elements of our products. You can then decide whether you want to continue to keep our product. We will inform you by email if we make changes to our services. If you continue to use our product after you have been informed of any price or product changes, this will be considered acceptance.

If payment is not received, MyData reserves the right to block, close or make the solution unavailable immediately. If you have chosen a monthly payment plan and your payment is missing for two consecutive months, My Data also reserves the right to issue an invoice for the total amount corresponding to the entire binding period.

Business purchases
All payments for our services must be paid in advance and your payment will automatically be charged within the chosen subscription period from 1 month to 48 months. If you choose to pay by credit or debit card, you accept that we automatically debit your account. If you wish to terminate your payment arrangement with MyData, you must notify us in writing at info@my-data.dk. Please note the applicable termination terms at all times. Payments to MyData are non-refundable unless covered under the terms of these conditions. You accept that you cannot reverse your payment via your bank for payments to MyData. If you do not accept this, you will be held liable for all costs associated with such action.

Please note that all prices on the business website are exclusive of VAT. We do not charge card fees. The agreement on the delivery of security to businesses is automatically renewed for the same period unless terminated with at least 3 months’ notice prior to the expiry of the initial period. In each of these extension periods, the agreement/leasing agreement must be terminated with at least 3 months’ notice before the end of an extension period.

When you make a purchase via our partner Grenkeleasing ApS, the terms and conditions of Grenkeleasing ApS will apply during the agreement period. These will be presented and shared with you before you complete your purchase.

 

Consumer purchases
You can pay with Visa, MasterCard, Dankort and ViaBill. We do not charge card fees. The amount is only debited from your card when the goods are dispatched. For purchases with ViaBill, you will only receive your goods after payment. Acceptable use
You agree not to misuse the software products. For example, you may not – and may not attempt to – use our service for the following actions:

  1. Probe, scan or test the vulnerability of systems or networks.

  2. Misuse or otherwise circumvent any security or authentication measure.

  3. Send viruses, perform overloading, flooding or spamming.

  4. Plant malware or otherwise send malware via our services.

  5. Send advertising, spam or other forms of false information – also known as spoofing or phishing.

  6. Breach Danish law in any way through your use of our backup software, product or service.

 

Receipt for card payments
All customers at MyData who purchase with a credit card will have access to a receipt.
Our customers automatically receive a receipt for the transaction on their customer page.

 

Renewal/deletion of payment cards
If you wish to renew or delete a payment card, contact MyData by email at info@my-data.dk. In this inquiry, no card details may be provided, only the request for deletion/renewal, after which we will of course comply with the request. For renewal, the card is renewed by the customer on their own via their customer page.

 

Subscription service
With MyData Subscription Service you pay via your credit card. After your first payment, your future invoices will automatically be paid from your card and there will therefore be no invoicing fees. Since security is a top priority for us, this method ensures that you only have to enter your card details once. Your card details will be stored securely by our payment provider. The subscription continues until it is terminated. The subscription will automatically be renewed for the same period that you have chosen. If your software product is billed monthly, you will be included in subscription adjustment. At MyData, our monthly paying customers are billed on the 2nd of each month, to make this more manageable and to avoid sudden charges in the middle of the month. The first month is billed in full when you purchase MyData. The following month you only pay for the days up to the 2nd of the month. For example, if you purchase your product on 21 February, you will only pay for the days up to 2 March the following month, i.e. 10 days. If you have made an agreement with ViaBill, their terms will always apply to your payment. The terms for ViaBill can be found in the ViaBill section further down.

Right of withdrawal for subscriptions (Consumers only)

 

For subscriptions
As a consumer, you have a 14-day right of withdrawal when you shop with us.
The withdrawal period expires 14 days after the day we have entered into the agreement.
This means that you have 14 days from the date of the agreement to inform us that you wish to withdraw. You can send an email to info@my-data.dk or use the standard withdrawal form which you will find at the bottom of these terms.

Refund
If you regret your purchase, you will get your money back.
We will refund the amount to you without undue delay and no later than 14 days from the day we received notice that you wish to exercise the right of withdrawal. We will return the money using the same means of payment that you used for the purchase, unless we have agreed otherwise.

 

Returns
Once you have informed us that you wish to cancel your purchase, you have 14 days to send the goods back to us.
You must pay for the return shipment yourself and you are responsible if any damage occurs during transport.

Condition of the goods when you return them
If the goods have lost value because you have used them in a way other than what was necessary to establish the nature, characteristics and functioning of the goods, you may only receive a partial refund of the purchase amount. The amount you can get back depends on the goods’ commercial value and in some cases it may mean that you only get the shipping costs back.
We recommend that you return the goods in the original packaging.
If the original packaging is missing, this may result in a decrease in the value of the goods.

 

Refund of the purchase amount
If you regret your purchase, you will receive your money back. If the goods have decreased in value, we will deduct the amount for which you are liable.
We will refund all payments received from you, including delivery costs (this does not include additional delivery costs in cases where you have chosen a form of delivery other than the cheapest standard delivery we offer), no later than 14 days from the day we received your notice that you wish to withdraw from the agreement.
We will return the money using the same means of payment that you used for the purchase, unless we have agreed otherwise.
We can withhold the refund until we have received the goods, unless you send us documentation that you have returned them.

 

Right of withdrawal in business purchases
Business customers do not have a right of withdrawal unless otherwise agreed in writing.

 

Newsletter and contact by email
When ordering a MyData software product, you have the option to give MyData your consent to contact you by email. The email may contain information about new software products, tips for further securing your IT equipment or relevant news. You can unsubscribe from these emails at any time by writing to us at info@my-data.dk or by unsubscribing directly in the newsletter. Please note that even if you opt out of marketing emails from us, we may still need to send you information about your product in order for you to get full benefit from it. MyData ApS does not sell your contact details to third parties.

 

Setup fee
If there is a setup fee for your MyData software product, this will always be clearly stated in your product price. There will never be any setup fee at MyData that is not clearly indicated.

 

Licence limitations
With MyData, it is not necessary to purchase separate security software for each device. Under your software agreement, there will be a specific indication of exactly how many devices you are licensed for in your solution.

Use and limitations of demonstration software

 

By using demo software, such as MD and MyPass Demo versions, provided by My Data ApS or their partners, you accept these terms and conditions. You receive a non-exclusive, non-transferable licence to use the software for demonstration, testing or evaluation. You may not modify, adapt, reverse engineer, resell, rent out, distribute the software or use it for commercial purposes without an additional licence. All content in the software is protected by intellectual property rights and remains the property of the Provider. The software is supplied without warranties, and the Provider disclaims all liability for damages or losses arising from its use. Liability is limited to the amount paid for the software, if any. Information obtained through the use of the software must be treated as confidential. The licence automatically terminates upon breach of these terms and you must then stop using and delete all copies of the software. The Provider, My Data ApS, determines the expiry date of the licence, which will typically be 3 months from the date of issue.

 

Campaign offers and free periods
Free months are given as a total discount based on the agreed period being completed in full without termination. In the event of early termination, payment is recalculated to the standard monthly price for the period used and any remaining free period lapses without refund.

 

When MyData sells private solutions, the consultant can choose to offer 1–2 years free period at the price of 1 year. If the customer in these cases terminates after 12 months, the customer is not entitled to a refund regardless of the total agreement period, which can be up to 36 months. If the customer terminates before 12 months, we only have to refund based on the standard price and period of 12 months, not all 36 months.

 

Upgrades – Downgrades
You can upgrade or downgrade your backup solution with MyData at any time. Your online backup solution will then automatically be adjusted to the desired level. For upgrades, you will receive a new invoice for payment, after which your agreement will automatically be upgraded. You can also downgrade your agreement, which will automatically be adjusted at the next renewal. You make the adjustment by contacting our customer service, who will be happy to assist you. As security is the highest priority at MyData Backup, we use different data centres for our customers’ data. We have both European and American data centres to match our customers’ wishes. On our professional servers we have an uptime of 99.99%. This is because we only reserve brief periods for system maintenance at night.

 

Logins, users and allocation
With MyData you can create separate logins for your software products. If you want a separate user for your accounting department or family-separated logins, you can create users for your solution. For each user, you allocate the amount of data that the user should be assigned based on what remains under the agreement. You can adjust the amount of data allocated to a user at any time in order to free up space for other users. Likewise, you can upgrade and purchase additional space. Changes to the allocation of data volume are made via the MyData Dashboard. Here you can add and remove data space from the users you have created for the backup solution.

 

Additional terms for the use of MyData Backup
With MyData Backup you have several levels of online backup security, including UltraSafe and UltraSafe Max. At our highest security levels, we are excluded from being able to assist our customers, because the security is so high that neither we nor our storage providers have the encryption keys for our customers’ files. For any security change to your agreement, it will be indicated what customer responsibility follows. As a customer, you can choose that we do not have access to the encryption key and that you yourself have a master password for your backup storage. This allows for a 100% private account that only the customer can access. However, this also removes MyData’s ability to provide support, which is why we recommend that you consider this carefully. If you have questions, our support is ready to assist. With MyData Backup you have tools that can be set to delete files in the cloud storage and on the computer after a chosen period. It is the customer’s responsibility to choose the desired settings. If the customer does not make changes to either settings or installation, you will receive our “Forever Safe” level, which never deletes files from the cloud storage even if they are deleted locally on the computer. If you change the level, you will be subject to the rules associated with that level for your online backup solution. Contact our support at the slightest doubt.

 

UltraSafe
At MyData, security is the key word. We therefore have many different layers of encryption so that our customers can tailor their backup security level according to their wishes. With UltraSafe and UltraSafe Max, the encryption keys are assigned to the customer. By using the UltraSafe and UltraSafe Max functions, the customer waives their support options, as the customer alone holds the key to their files and the encryption thereof. UltraSafe Max also has an additional passphrase. If this passphrase is lost, the files cannot be accessed or restored. The choice of UltraSafe and UltraSafe Max is the customer’s own responsibility, as our support for the solution is removed along with the lack of access. When choosing this, we will provide a warning in our online backup, so that the customer themselves makes the final decision.

 

Selection of files for backup
It is always the customer’s own responsibility to choose the data to be backed up and to follow up on this. In our installation you will have access to several online backup tools, including our Smart Scanner. The Smart Scanner only scans for the file types and locations that are indicated. If Easy Setup is chosen in the installation phase on Windows, you will receive an automatic backup solution for the common folder locations: Desktop – Documents – Pictures – Music – Video. If Advanced Setup is chosen in the installation phase, you must yourself decide on encryption level, selection of folders for backup and run times. In both cases it is the customer’s responsibility to ensure that the selection covers the desired data.

 

File versions
With MyData you have unlimited file versions. All uploaded versions will therefore be saved on our servers so that you have the option to “go back in time” if something has been saved incorrectly. As a customer, you can adjust the rules for the versions, where all versions are saved unless adjustments are made. The latest version will always be the one displayed in the Dashboard.

 

Backup of file types
MyData can continuously adjust the limitations on file types that are accepted for online backup storage. This is to achieve the most stable backup product for our customers. MyData will always have the applicable terms stated in its material. It is the customer’s responsibility to stay updated via our customer database and terms of trade.

 

Forever Safe and storage
With MyData you have several options for file storage directly in the cloud, including Forever Safe. For files that are only in the cloud storage and are manually deleted from there, this is a permanent action. This action cannot be undone and as a customer you will therefore be warned before confirmation. As a customer you are responsible for understanding the functions in the various backup solutions that you choose and enter into.

 

The “WIPE” function
MyData has a tool named WIPE. This feature gives access to delete all online backup from the device, or delete all files on the device via the Dashboard. This backup feature must be used carefully, as it can leave the device unusable and even without an operating system. This feature can be used, for example, in the event of theft of equipment, where you can ensure that your files do not fall into the wrong hands. Warnings will therefore be displayed on the Dashboard when using this feature. If you are in doubt about the function, we recommend that you speak with one of our experts before use. It is the customer’s responsibility to understand the consequences of using the feature.

 

Backup maintenance
We constantly strive to secure our customers’ backups as best as possible. One initiative is to continuously search for online machines without backup jobs configured. If a computer is online without active backup runs, we will, if technically possible, create a backup from the cloud directly to the local device. Our goal is to protect the areas that are accessible from the cloud and that we identify as essential on online devices without configured jobs. Fully encrypted. Contact our support if you want help with your setup.

 

Backup of mobile devices
MyData has backup products that allow backup storage of mobile devices with iOS and Android systems. If you are unsure whether your agreement includes this, you can contact our support at any time. In the backup software it will be stated which files your mobile device allows backup of. Online backup of mobile devices has “Forever Safe” as cloud storage setting. The files that are backed up will therefore all be stored in the cloud indefinitely. It is the customer’s responsibility to delete unwanted files from their Dashboard.

 

Upgrade in case of overuse
For security reasons, your backup of initially selected areas will always be protected and uploads will never be blocked if the purchased data volume is exceeded. Our customers can always clearly follow all data usage with us in both the software and the Dashboard. We can also be contacted at the slightest doubt. Our customers can always adjust their secured data online in the Dashboard and remove any unnecessary or unwanted data. After an account has exceeded its data quota for 10 days, it will automatically be upgraded and invoiced in accordance with the billing terms applicable to the agreement. An upgrade will always consist of 20% of the previously purchased data quota and will be invoiced at 20% of the agreed price.

Service terms for MyPass software

 

General
These terms apply between the individual user of the service at mypass.mydata.dk and MyData. These terms constitute the agreement that exists between the user, the service and MyData.

  1. Registration and user access
    The user is responsible for ensuring that the information is correct at the time of entering into the agreement. At payment the user may only provide information related to their own payment and credit card. At the first registration to access the service, the user must enter a username and password (hereafter called “login details”). The user’s login details are personal and may not be used by others.

The user must store their login details in a safe place so that others cannot gain access to them. The user is responsible for all use of their account. If the user suspects unauthorised use of their login details, the user must immediately notify MyData and change their password.

  1. Fees and payment
    Payment for the subscription is made according to the periods chosen in the subscription and will automatically be renewed for the same period again unless the service is terminated beforehand.

  2. Adjustments and changes
    MyData reserves the right to change fees and other conditions for the service. Changes must be notified to the user at least thirty (30) days before they come into effect. In the event of such changes, the user has the right to terminate the account with effect from the date the change comes into force. If the user does not terminate the account before the change takes effect, this will be considered acceptance of the change. Changes that are clearly to the benefit of the user will take effect immediately without notice to the user.

  3. Liability
    MyData can under no circumstances be held liable for direct, indirect, incidental or special losses, damages or consequential damages. Under no circumstances can MyData be held liable for loss of profit, revenue, income, data or use, whether caused by an act by you or a third party under contracts arising from your access to or use of the website.

 

Special service terms for MyData Remote Assistant

  1. Use of website information
    You may download, view, copy and print documents and graphics that are incorporated in these documents (“Documents”) from the website subject to the following: (a) The Documents may only be used for personal, informational, non-commercial purposes; and (b) The Documents may not be modified or altered in any way. Unless your use constitutes “fair use” under copyright law, you may not otherwise use, download, upload, copy, print, display, perform, reproduce, publish, license, post, transmit or distribute any information from this website, in whole or in part, without express permission from MyData.

  2. Disclaimer
    MyData can under no circumstances be held liable for direct, indirect, incidental or special losses, damages or consequential damages. Under no circumstances can MyData be held liable for loss of profit, revenue, income, data or use, whether caused by an act by you or a third party in contracts arising from your access to or use of the website.

Unless otherwise expressly stated, the website and all content, materials, information, software, products and services provided on the website are provided “as is” and “as available”. MyData expressly disclaims all warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose and non-infringement.

 

MyData does not warrant that: (1) The website will meet your requirements; (2) The website will be available on an uninterrupted, timely, secure or error-free basis; (3) The results that may be obtained from the use of the website or any services offered through the website will be accurate or reliable; or (4) The quality of any product, service, information or other material purchased or obtained by you through the website will meet your expectations. Any content, materials, information or software downloaded or otherwise obtained through the use of the website is done at your own discretion and risk. MyData assumes no responsibility for any damage to your computer system or loss of data arising from the download of content, materials, information or software.

 

MyData reserves the right to make changes or updates to the website at any time without notice.

  1. Indemnity
    You agree to defend, indemnify and hold MyData, its directors, employees and agents harmless from and against all claims, liabilities, damages, losses or expenses, including reasonable attorneys’ fees and costs, arising out of or in any way related to your access to or use of the website.

  2. Use of software
    Any use of software and accompanying documentation that you download from the website is subject to the terms of a software licence agreement between you and MyData. You must read the licence agreement and indicate your acceptance of its terms before installing or using the software. All rights, title and interest not expressly granted are reserved.

  3. Third-party websites, content, products and services
    The site provides links to websites and access to content, products and services from third parties, including users, advertisers, affiliates and sponsors of the website. You agree that MyData is not responsible for the availability of or content on third-party websites. You should refer to the policies posted by other websites regarding privacy and other topics before using them. You agree that MyData is not responsible for third-party content accessible via the website, including opinions, advice, statements and advertisements, and you understand that you bear all risks associated with using such content. If you choose to purchase products or services from a third party, your relationship is directly with the third party. You agree that MyData is not responsible for: (1) The quality of third-party products or services; and (2) The fulfilment of any terms of your agreement with the seller, including delivery of products or services and warranty obligations related to purchased products or services. You agree that MyData is not responsible for any loss or damage of any kind you may incur by dealing with a third party.

 

Special service terms for MD

The provider makes the service available to you provided that you comply with the agreement. The service is provided “as is” and “as available” for your personal and non-commercial use. The provider assumes no responsibility, regardless of the cause, for any unavailability of the service or lack of functionality due to difficulties with or lack of access to content or other communication system failures. You can use the service to search for unwanted or unauthorised behaviour by using your personal data, computer, bank account or similar. It is important to note that the provider is not responsible for damages or consequences of such behaviour, even if the service has been defective or unavailable. The provider also assumes no responsibility for the detection of unwanted or unauthorised behaviour. The provider has the right to suspend your access to the service at any time.

  1. Limitations
    To use the service, you must be authorised to enter into agreements under Danish law and be over 18 years of age. The service is intended for personal use, and you may not use it to search for email addresses belonging to other persons or third parties. It is your responsibility to ensure that the information you share with the provider does not violate the rights of others or break the law. You are not permitted to (i) transfer your right to use the service to third parties, (ii) attempt to derive the source code from the service, or (iii) remove notices of ownership, copyright or other rights included in the service. The provider may suspend your access to the service if it has reasonable grounds to believe that you are using it in a manner contrary to the agreement.

  2. Disclaimer
    The service is provided “as is” and “as available”, and the provider disclaims all types of warranties and representations, whether express or implied. The provider specifically disclaims all implied warranties, including merchantability, fitness for a particular purpose and non-infringement, to the extent permitted by law.

  3. Liability
    You are not entitled to compensation for direct or indirect damages. The provider is not liable for indirect damages or losses, including but not limited to loss of profit, business opportunities, use, goodwill, data or other indirect, punitive, special or consequential damages, regardless of the cause.

  4. Force majeure
    The provider assumes no responsibility for failure or delay in performing the agreement due to events beyond its control, such as labour disputes, war, embargo, government intervention, pandemics, natural disasters or delayed performance by subcontractors due to the mentioned causes.

  5. Intellectual property rights
    The service and its components remain the property of the provider and/or its licensors, including intellectual property rights. You have a limited, revocable licence to use the service for personal use in accordance with the agreement. You must indemnify the provider against any claims in connection with your use of the service.

  6. Third-party services
    Certain parts of the service may contain third-party services that are subject to third-party terms and copyrights. Your use of the service implies acceptance of these third-party terms, and you are responsible for any claims in this connection.

  7. Confidentiality
    Confidential information, regardless of form, must be kept confidential and you may not disclose it to third parties without the provider’s written consent. Your use of confidential information must comply with the agreement and its terms for a period of three years.

  8. Transfer
    The provider may transfer its rights and obligations under the agreement to a third party that is expected to fulfil the conditions to your satisfaction.

 

Delivery
Delivery of hardware is made by parcel post via our various partners. Delivery costs are always free within the borders of Denmark. The expected delivery time is approximately 1 week. All software is delivered by email or personal service and installation.

If there is something wrong with the subscription
If you are not satisfied with the subscription/membership, you can contact us via the main contact details indicated in these terms and conditions.

 

The rules on defects under the Danish Sale of Goods Act do not apply to subscriptions. Whether you have a 2-year warranty period under the provisions of the Sale of Goods Act therefore depends on the type of service to be delivered under the subscription agreement. If goods are to be delivered, the following applies: You can complain about defects that were present at the time of delivery for up to 2 years after delivery of the goods. This means that as a rule you can have the goods repaired, exchanged, get your money back or receive a reduction in price depending on the specific situation.

It is of course a condition that the complaint is justified and that the defect has not arisen due to improper use of the product or other damaging behaviour.

 

How quickly must I complain?
You must complain within “reasonable time” after you have discovered the defect in the goods. If you complain within two months after the defect has been discovered, the complaint will always be considered timely.

Charges on your card
You can at any time revoke your permission for us to charge an amount to your card. You can also raise an objection regarding unauthorised debits to your card issuer no later than 8 weeks after the debit, unless otherwise stated in your agreement with the card issuer.

 

Personal data
We need the following information when you shop with us:
Name, address, telephone number and email address.
We register and pass on the personal data that is necessary for us to deliver the goods to you.
The personal data is registered with My Data ApS and stored for five years, after which the information is deleted.
We also cooperate with a number of other companies that store and process data. These companies process data solely on our behalf and may not use it for their own purposes.
We only work with data processors in the EU or in countries that can provide your information with adequate protection. The data controller on mydata.dk is My Data ApS.
You have the right to know what information we process about you.

If you believe that the information is inaccurate, you have the right to have it corrected. In some cases we are obliged to delete your personal data if you request it. This may be the case if your data is no longer necessary for the purpose for which we needed it. You can also contact us if you believe that your personal data is being processed in violation of the law. You can write to us at: info@my-data.dk.
